First Operation Converting Confiscated Cryptocurrencies into Fiat Currency

Lorenzo Palombi, of counsel at the GPD legal and tax firm, acted as legal consultant for Young Platform, Italy’s leading cryptocurrency exchange, in the first operation converting confiscated assets in the form of cryptocurrencies into fiat currency. This pioneering initiative represents an important step forward in collaboration between the private cryptocurrency sector and public institutions, marking a significant moment in combating criminal activities. The Carabinieri Anti-Counterfeiting Monetary Command, the Department of Justice, and the Single Justice Fund (FUG) worked jointly with Young Platform S.p.a.

The operation, culminating in January 2023, is part of a broader investigative context initiated in July 2018, and is the result of careful investigation and coordinated legal actions, involving Eurojust and supported by Europol, which led to the arrest in flagrante delicto of over 31 individuals, eight of whom are in precautionary custody by order of the Judge for Preliminary Investigations of the Court of Naples, charged with criminal association aimed at trafficking in counterfeit currency on an international scale with terminals in numerous European and non-European countries.

The criminal network used the dark web and messaging platforms such as Telegram for the sale of counterfeit banknotes in exchange for cryptocurrencies as a payment method. Following the arrests, substantial sums of money in cryptocurrency were confiscated, including Bitcoin (BTC) and Monero (XRM), which were deposited in wallets managed by the Carabinieri Anti-Counterfeiting Monetary Command. Subsequently, pursuant to the confiscation decree, Young Platform S.p.a. was designated as an auxiliary of judicial police to proceed with the conversion of cryptocurrencies into fiat currency and their transfer to the Single Justice Fund (FUG).

This public-private collaboration: Law Enforcement, judicial authorities, and a cryptocurrency exchange represents a unique case in our country that establishes an important precedent for future collaborations between the cryptocurrency sector and judicial authorities. Furthermore, it establishes an operational procedure that will serve as a model for similar operations in the future.

The procedural framework adopted will be fundamental for standardizing practices and ensuring an effective and coordinated approach in combating financial crime. Consider that in 2023, the percentage of illicit volumes derived from cryptocurrencies stood at 0.34%, according to the “The Chainalysis 2024 Crypto Crime Report”, in constant decline since 2019. This demonstrates that cryptocurrencies and blockchain technologies have significant potential to contribute positively to society when used correctly.
