On Friday, May 17th, Andrea Gemma, Founding Partner of GPD and Associate Professor of Private Law at Roma Tre University, will participate as an instructor in the training program “Wealth Planning Instruments – Analysis of the Civil Law Framework and Tax Profiles of Individual Institutions”, organized by Paradigma Srl.
During his presentation, Andrea Gemma will address the topic “Separate Assets with Destination Constraints”, analyzing the following points:
- – Article 2645-ter of the Italian Civil Code: provision on the effects of other factual circumstances or general legal basis of destination transactions?
- – The destination deed: typical or atypical transaction?
- – The protection of assets as a legally worthy interest
- – The duration of the constraint
- – Revocability by the settlor
- – The identification of the beneficiary
- – Acts concerning constrained assets
- – Assets allocated to a specific purpose pursuant to Articles 2447-bis et seq. of the Italian Civil Code
