The challenged arbitration award had denied the Client reimbursement of the amounts paid to […] in connection with the contract for the supply of wind turbines for the construction of a wind farm, in the amount of 53 million euros.

The Milan Court of Appeals, upholding in full the appeal filed by the attorneys for […], declared the award null and void on the grounds that it contradicted the partial award that had already ordered the termination of the contract, which was subject to the unfulfilled condition precedent of obtaining project financing.
